Disciplinary Policy Summary

  1. The following is a summary of the conduct that may lead to disciplinary action by HTCC and of the procedure for addressing possible noncompliance. For a comprehensive explanation of the standards of conduct and review procedures, please read the full text of the HTCC Disciplinary Policy.
  2. Grounds for disciplinary action include (but are not limited to) to:
    1. Cheating, copying exam materials, and other misconduct during a HTCC examination;
    2. Nonpayment of fees or not providing information as required;
    3. Providing false or incomplete information to HTCC;
    4. Misrepresenting certification status;
    5. Being subject to disciplinary action by a licensing board;
    6. Being convicted of a crime related to public health or hand therapy; and
    7. Not providing updated information to HTCC as required.
  3. You must notify HTCC of any inquiry, indictment, or charge against you relating to public health or hand therapy, or relating to any other matter listed in the Disciplinary Policy as potential grounds for disciplinary action. Candidates and certificants must report events such as suspension, revocation, or expiration of a state license to practice, being sued by a patient, or being investigated or reprimanded by a state regulatory board. Notification must be made within ninety (90) days.
  4. HTCC may deny, revoke, suspend, reprimand, or refuse to renew certification for a violation of the Disciplinary Policy:
  5. Complaints and allegations of potential noncompliance are reviewed by the Disciplinary Review Committee. If an investigation confirms that misconduct may have occurred, a statement with detailed information about the matter and the hearing process will be sent to you, and you may request a review or hearing before the Disciplinary Hearing Committee. If a sanction is imposed by the Disciplinary Hearing Committee, that decision may be appealed to the HTCC Board of Directors. The decision of the Board of Directors is final. This review and appeal process is available if a sanction has been imposed against you for violation of the Disciplinary Policy. You may not appeal failure of the exam.
  6. The following eligibility questions are asked of all therapists during the Hand Therapy Certification and Recertification Process. These questions are repeated here as a reminder of the types of events that must be reported to HTCC at any time during your certification.
    • Have you ever been found to have acted with gross or repeated negligence or malpractice in the field of occupational therapy, physical therapy, or hand therapy?

    • Have you ever had a complaint filed against you before a governmental regulatory board or professional organization regarding public health and safety, occupational therapy, physical therapy, or hand therapy?

    • Have you ever been the subject of an investigation by law enforcement for conduct
      related to public health and safety, occupational therapy, physical therapy, or hand therapy?

    • Have you ever had your certificate, registration or license to practice subject to limitation, discipline, revocation, or other sanction (including voluntary limitation) by a governmental regulatory board or professional organization relating to public health and safety, occupational therapy, physical therapy, or hand therapy?

    • Have you ever been convicted of, pled guilty to, or pled nolo contendere to a felony or misdemeanor related to public health and safety, occupational therapy, physical therapy, or hand therapy, or are any such charges pending against you? (These include but are not limited to a felony involving rape, sexual abuse of a patient or child, actual or threatened use of a weapon or violence, and the prohibited sale, distribution, or use of a controlled substance.)
